Duties Description Claims Counsel shall be a position within Office of General Counsel’s Adjudicatory Services division, with cross-departmental reach between OGC and Claims. This position will involve coordination with the Director of Claims and her designees. The incumbent will report to a Deputy Counsel and the Chief Counsel/General Attorney.

Responsibilities include, but are not limited to:

• Develop high-level strategic integrated approaches to all decisional aspects within the claims lifecycle for issues within claims that are or may be subject to dispute.
• Develop and implement staffing plans and direct the coordination of assets involved in the dispute resolution process.
• Foster interdepartmental communication regarding management of the legal-claims portfolio, which includes claims involving private employers, safety groups, and state employees, from the approach that NYSIF is a public-purpose carrier and must have best-in-class claims management of our internal assets and external spend.
• Identify gaps in the management of adjudication of issues and disputes in the claims life cycle including:
o all aspects of decision making, controversies, all forms of loss allocation expenses,
o utilization of in-house and outside counsel handling of hearings, and depositions,
o creation and evaluation of data and KPIs and develop strategic approaches to more effective management of claims, focused on both internal resources and vendors.
• Communicate with key external stakeholders as appropriate, including safety group managers, outside counsel, IME entities, and others.
• Communicate and coordinate with the Director of the Appeals unit within Adjudicatory Services regarding strategic approaches, lifecycle issues, and data analytics.

Minimum Qualifications Non-Competitive Promotion (NCP): In accordance with Section 52.7 of the Civil Service Law, if the number of qualified candidates who apply for the position is three or less, a permanent appointment may be made, at agency discretion, by non-competitive promotion of an applicant who meets the minimum qualifications.

Minimum Qualifications:

• Non-Competitive Promotion or provisional appointment: one year of service as a Principal Attorney.

• Transfer: Current New York State employee with one year of permanent competitive class service in a title eligible for transfer under Section 52.6 of Civil Service Law. Appointments via transfer must not result in a second, consecutive transfer with an advancement of more than two S-grades or one M-grade. Eligible titles include, but are not limited to: Principal Attorney, Administrative Officer 6, Supervising Comp Claims Referee
