Duties Description As a Compliance Specialist 3, the incumbent will be expected to have frequent written and oral communications with agency program managers and staff, state and federal agency staff, and representatives of business, unions, and public and private organizations to promote and explain the program, evaluate compliance activities, negotiate solutions to problems, provide technical assistance and advice, interpret statutes, policies, rules, and regulations, evaluate program effectiveness, and exchange information. Incumbents must exercise tact and diplomacy to gain cooperation and support for the program, negotiate solutions to problems, and encourage compliance.
The incumbent will supervise lower-level Compliance Specialists and office clerical staff by assigning staff to audits and projects, reviewing work for accuracy, completeness, and compliance with program requirements, evaluating performance, training, establishing program priorities, interpreting policies, procedures, laws, rules, and regulations, and resolving complex problems.
The incumbent will:
• Provide supervision, guidance, and oversight to the Compliance Supervisors (within assigned regions) to ensure all duties are performed accurately and timely.
• Assist with revisions to the Department’s Standard Specifications and MURK Manuals as they relate to the compliance duties of the Regional Compliance Staff.
• Develop and provide training for the Regional Compliance Supervisors in their roles and responsibilities.
• Review and provide comments on draft official issuances and proposed changes to civil rights regulations.
• Assist in the implementation and development of policies and procedures related to compliance.
• Train compliance staff on performance of goal assessments during the design phase of a contract and goal waivers.
• Take lead on matters of greater complexity, in coordination with the Office of Construction Compliance Manager.
• Ensure that roles and responsibilities of the Compliance Supervisors are covered in times of vacancies.
• Provide temporary oversight and supervision of other regions in the event of a vacancy or extended absence of a Compliance Supervisor.
• Perform QA Review of FHWA Compliance Reviews and submit to Office of Construction.
• Assist in the implementation and further development of policies and procedures regarding substitutions/reductions/terminations for proper documentation and provide approval/concurrence.
• Assist in the implementation and further development of policies and procedures regarding QA review of GFE documentation and provide concurrence.
• Review applications for vacant lower-level compliance titles and perform interviews, consult with Office of Construction if needed.
• Assist in the implementation and further development of policies and procedures regarding Commercially Useful Function (CUF) Reviews of Off-Site DBE/MBE/WBE/SDVOB firms (i.e., Manufacturers, Fabricators, Material Suppliers, Distributors, Professional Services, Work Services)
• Perform oversight of any mega projects within your regional jurisdiction.
Responsibilities may include serving a role within the Incident Command System to support the department’s response to regional and statewide emergency situations.
Minimum Qualifications Eight years of experience in the review, investigation, and/or evaluation of compliance with equal employment opportunity laws, rules and regulations; in the planning, development, implementation, and review of programs dealing with equal employment opportunity, human rights, affirmative action, minority business program coordination, and/or labor relations directly relating to affirmative action; or in the development and administration of programs designed to facilitate minority community access to employment or business opportunities in the public and private sector.
One year of this experience must have been at a supervisory level. A bachelor’s degree may substitute for four years of the non-supervisory experience. A master’s degree may substitute for one year of the non-supervisory experience.

The salary range listed reflects the full range for this graded position. For new State employees appointed into graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts. Note: Although this position will report to the Office of Construction in Albany, NY, the physical work location will be Main Office, Regions 1-7 or Region 9 based upon the geographic location of the selected candidate.
