Duties Description The incumbent will support the Department's work in relation to the PACE program, and is needed to manage the rulemaking process for the unified PACE licensure process and combined operational requirements from both a health plan and facility perspective, to negotiate model contract amendments necessary for the appropriate oversight of the expansion of the PACE product, and to handle ongoing licensure and operational program counsel responsibilities in connection with the oversight of the PACE model. The incumbent will Review Regulations for the PACE program and related programs. Work with program to adjust language. Help review and respond to public comments. Participate in stakeholder meetings. They will Review questions and provide counsel to program staff as needed. Review and make amendments to model contracts and the PACE program agreement with CMS. Interface with CMS alongside program counterparts. Field inquiries of legal nature from stakeholders and support bureau of litigation in responding to litigation. Negotiate, Draft and Review MOUs. Review and draft memos on proposed legislation. Review EDCCs and respond to assigned ECUs. Draft opinion memos for program staff and supervisors. Participate in budget related preparation and negotiations. They will Review application, including applicant org structures. Provide counsel to program on acceptability of org structure. Work to help support applications that DOH approves of before PHHPC. Lastly, they will Review IPA applications, Review Consent to file requests, Provide backup to other attorneys.

Minimum Qualifications Reassignment: Current NYS Department of Health (DOH) employee with permanent or contingent permanent status as an Assistant Attorney 1, NS, Assistant Attorney 2, NS, Assistant Attorney 3, NS or Senior Attorney, G-25.

Transfer: Current NYS employee with one year of permanent or contingent permanent competitive service in a title eligible for transfer under Section 70.1 of the Civil Service Law.

NY HELPS:

Assistant Attorney 1, NS: Law school graduation and/or eligibility for NYS Bar Admission.

Assistant Attorney 2, NS: Admission to NYS Bar.

Assistant Attorney 3, NS: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience.

Senior Attorney, Grade 25: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.

NOTE: Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment. Position may be filled at the Senior Attorney level or one of the Assistant Attorney traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected. This position may be designated 55-b/c and is subject to verification of applicant eligibility.

Preferred Qualifications: Will demonstrate excellent oral and written communication skills. Will demonstrate good decision making under pressure and can manage a varied and demanding caseload. Will have familiarity with licensure requirements for managed care organizations, hospitals, and home health agencies.
