Duties Description The Region 7 Associate Attorney will report to and provide direct support to the Regional Attorney on issues of a high-profile nature and assist with carrying out critical responsibilities in developing and implementing statewide policy at the regional level, including but not limited to Environmental Justice and the Climate Leadership & Community Protection Act, wetlands enforcement and permitting, and handling sophisticated and complex legal matters with a high degree of independence, to serve the needs of the region.

In addition to providing direct support to the Regional Attorney, the Associate Attorney will provide legal counsel with regard to permitting and enforcement at a level of expertise beyond that expected from a Senior Attorney (Grade 25).

Enforcement is the central focus of regional legal practice, and the Associate Attorney will be responsible for taking lead on significant enforcement litigation and is expected to work with a large degree of autonomy. Unlike the handling of routine permit and enforcement cases assigned to Senior Attorneys, the Associate Attorney is required to consider the broader issues confronting Central New York and the Southern Tier, and together with policy makers, industry representatives and public input, develop strategies for addressing the numerous and complex
environmental issues.

The Associate Attorney will be responsible for directly supervising work product of junior legal staff which may include Senior Attorney, Legal Assistant and/or Legal Interns. The Associate Attorney will also be responsible for responding directly to inquiries from the Department’s General Counsel, Regional Director, Assistant Regional Director, and Division Directors on controversial, high-profile matters for which little or no legal precedent has been established.

The Associate Attorney is responsible for representing the Department in administrative enforcement hearings, drafting and negotiating administrative consent orders, preparing referrals to the Attorney General, training new legal staff, providing legal advice to staff, as well as other duties assigned by the Regional Attorney.

Reinstatement Eligible - Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis.

Transfer Eligible - One year of permanent competitive service at Salary Grade 26 or higher and either:

Eligible for transfer under Section 52.6: Must have current or prior service in a title designated as 52.6 within two salary grades\one M grade of this position and possess the appropriate license. To determine if your title is designated as 52.6 go to the Department of Civil Service website and search for your title under GOT-IT.
