Salary RangeFrom $137457 to $173664 Annually
Duties Description Under the direction of the Chairperson, the incumbent will oversee the Division of Private Sector Employment Practices and Representation. The director is responsible for all work within the Division, consistent with the statutes, rules of procedures and mission of the Private Sector Employment Practices and Representation. Duties include, but are not limited to:
Oversee all matters pertaining to the regulation of unfair labor practices; employee representation; supervision of elections to determine majority status; and eligibility for certification of employee organizations. Edit written decisions of administrative law judges to assure consistency with precedent. Review and process all charges, petitions and applications under the applicable Acts and Rules of Procedures. Convene and preside at conferences to assist employers and employee organizations in resolving improper and unfair labor practice charges or enter into stipulations of fact which may eliminate or limit the need for a formal hearing. Preside at quasi-judicial or administrative hearings which are of an adversarial or investigative nature concerning resolution of issues of fact and law. Evaluate evidence; make findings of fact and conclusions of law and render written decisions or recommendations. Respond to a variety of relevant inquiries. Ensure compliance with executive management decisions. Supervise training and performance of division staff. Other duties as assigned.
Minimum Qualifications Admission to the New York State Bar and ten years of substantial experience in the field of labor-management law and labor-management relations, including familiarity with the private sector, including but not limited to experience as a neutral deciding or resolving disputes over terms and conditions of employment or representation issues or as an employer or union advocate in the adjudication and resolution of such labor-management disputes. Experience in supervising staff must be evident.
