Minimum Qualifications Candidates must be a current New York State employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a New York State employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23 or above with current New York State Bar Admission and eligible for transfer to Senior Attorney under Sections 70.4 or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree.)

Preferred Qualifications
The ideal candidate should be a highly motivated individual interested in working in public service with excellent written and oral communication skills, sound judgement, and a desire to learn new subject areas. As this position supervises a staff of five employees, experience supervising staff is preferred.

Duties Description The Senior Attorney in FOIL/Subpoena would provide legal expertise and advice concerning Freedom of Information Law (FOIL) requests from the general public, the media, public employee unions, and other groups and individuals. The primary responsibility of the position would be to insure the efficient, timely and legally compliant response to requests for records submitted via a FOIL request or a subpoena. The attorney would be responsible for compliance with the federal Driver’s Privacy Protection Act, the Public Officers Law, the CPL and CPLR, and applicable provisions of the Vehicle and Traffic Law. The attorney would also be responsible for Records Management and giving advice about proper retention periods for record. The attorney would supervise five clerical staff. The attorney must have good interpersonal skills, because he or she will interact with all offices within the Department of Motor Vehicles offices to obtain records.
