Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service as a Associate Attorney (G-28); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 26 or above with current NYS Bar Admission and eligible for transfer to Associate Attorney under Sections 70.1 or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree, and may also need to meet additional experiential conditions to qualify for consideration.)

Preferred Qualifications: Possess a law degree from an accredited law school, have been admitted to, and be in good standing of, the New York State Bar; have excellent speaking, writing and research skills; and have at least five years’ experience in administrative hearings or criminal or civil litigation. Prior prosecutorial experience preferred.

Duties Description An Associate Attorney in the Bureau of Professional Medical Conduct would be responsible for prosecuting cases of professional misconduct involving physicians, physician assistants, specialist assistants and medical residents. An Associate Counsel would be expected to handle complex clinical and non-clinical professional misconduct cases. This would entail providing legal advice and assistance to the Office of Professional Medical Conduct with investigations; drafting subpoenas; rendering opinions and making recommendations regarding the legal sufficiency of misconduct matters; negotiating and drafting Consent Agreements, Surrenders, Interim Out-of-Practice Agreements, and Non-Disciplinary Orders of Conditions; reviewing medical records, business records, expert reports, quality assurance materials and other documents; interviewing fact and expert witnesses; drafting Statements of Charges and Summary Suspension documents; representing the Department at Summary Suspension, Direct Referral, and regular disciplinary hearings, PHL 230 (7) proceedings to determine whether a licensee must submit to psychiatric or physical examinations or a clinical competency assessment, and Violation of Probation Proceedings; drafting appellate briefs for the Administrative Review Board; and providing assistance to the Litigation Bureau in state and federal court cases involving licensees.
