Job Specifics
Duties Description Reporting to an Associate Counsel, the incumbent of this position will serve in the Office of Cannabis Management's (OCM) Office of General Counsel and will manage a portion of the legal portfolio, including but not limited to one or more of the following areas of practice common to a regulatory agency: legislation and statutory interpretation, regulatory development, licensing, compliance, enforcement, administrative hearings, external litigation, contract review, and other matters fundamental to governmental administration. More generally, the incumbent will assist with carrying out general legal responsibilities for the Office of Cannabis Management and the Cannabis Control Board (Board), including researching, analyzing, and interpreting laws applicable to the Office and Board.
Duties may include, but are not limited to:
• Collaborate with OCM’s Enforcement Unit. The incumbent will prepare for judicial or administrative proceedings by reviewing cases involving licensed and unlicensed businesses, discussing strategy, coordinating investigations, examining case folders, conferring with program officials, preparing complaints and legal memoranda, and issuing subpoenas.
• Prepare and present cases at proceedings by preparing opening statements and summations, arguing motions, examining witnesses, consulting with parties to the proceeding, examining evidence, preparing briefs, negotiating settlements, preparing appeals, and advising superiors.
• Review, analyze, and comment on amendments to regulations pertaining to compliance, enforcement, and administrative hearings related thereto.
• Collaborate with the Office of the New York State Attorney General. The incumbent will prepare for New York State Supreme Court and Federal Court actions by discussing strategy, examining case folders, conferring with program officials, and drafting affirmations and legal memoranda.
• Examine and gather evidence for motions to dismiss, motions for summary judgment, and pre-trial discovery in numerous matters.
• Review and edit briefs, negotiate settlements, review and edit appeals, and advise superiors.
• Assist as necessary with preparation and finalization of rules and regulations in support of OCM and the Board’s business units including processing in accordance with the State Administrative Procedure Act.
• Conduct legal research and prepare legal memoranda with opinions and citations and legal precedents in support of OCM and Board programs.
• Provide legal counsel, advice, and strategies in support of OCM and the Board.
• Handle and process FOIL requests on behalf of OCM and the Board.
• Other duties may be assigned as appropriate.
Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had two years of experience in the practice of law subsequent to admission to the Bar.
NOTE: IN ORDER TO AWARD THE PROPER CREDIT FOR WORK EXPERIENCE, RESUMES MUST INCLUDE MONTH AND YEAR FOR START AND END DATES. IF ANY OF THIS EXPERIENCE IS LESS THAN FULL TIME YOU MUST INDICATE THE AVERAGE NUMBER OF HOURS WORKED PER WEEK.

• Travel may be required (approximately 5%), including during evening and weekends, depending on mission and assignment.
• Possession and maintenance of a valid Driver’s License issued by the NYS Department of Motor Vehicle is required or otherwise demonstrate the capacity to meet the transportation needs of the job.
