Job Specifics
Minimum Qualifications Candidates must have one year of permanent, competitive or non-competitive 55b/c service as a Senior Attorney, eligible for appointment from civil service list OR be eligible for transfer under Section 52.6 or 70.1 of the Civil Service Law.
Duties Description The candidate will be responsible for providing support to other Divisions within OMIG in the form of legal advice, review and analysis, as well as conducting general and specific legal research of issues relating to Medicaid and Employment matters. The candidate will assist staff at all levels of the agency (i.e., agency program managers and audit and investigation staff), and will advise staff on issues relating to the application of federal and state Medicaid laws, rules and regulations, and other laws affecting OMIG’s activities, operations, and/or overall mission. Matters that an attorney assigned to this area might be asked to work on includes, but is not limited to: handling and processing FOIL requests on behalf of the agency and assisting with employment law related issues such as labor or disciplinary matters and agency representation before administrative employment boards. In addition, the candidate will advise OMIG staff regarding legal matters that arise in litigation, and will provide assistance to the Attorney General’s Office in such matters including: reviewing court papers, assisting in drafting answers, memoranda of law and other responsive documents, responding to recovery requests, obtaining and assisting in the preparation of affidavits and in the development of the OMIG’s legal position and strategy toward the case. The candidate will be responsible for representing the OMIG in administrative hearings involving the recoupment of money from, and/or the imposition of, a sanction against Medicaid providers. This includes preparing the case for hearing, interviewing witnesses, conducting witness preparation, preforming direct and cross examination, preparing opening statements and post-hearing briefs.
Additional Comments Preferred Qualifications: Experience and/or knowledge of Health Law and/or Medicaid Law and Employment Law; and at least 5 years of extensive litigation experience in state or federal courts and/or administrative forums preferred. Candidate must have excellent analytical, and writing skills. Candidate should be self-motivated, able to work as part of a team, organized, efficient, and possess good inter-personal skills.
