Minimum Qualifications Admission to the New York State Bar and three years of post-New York State Bar experience as an Attorney, one year of which must have involved in the defense or prosecution of white collar crime.**

**White collar crime is defined as an illegal act committed by non-physical means and by concealment or guile to obtain money or property; to avoid payment or loss of money or property; or to obtain business or personal advantage.

Duties Description The incumbent provides legal advice to Criminal Investigations Division (CID) staff located within the assigned District Office. Specifically, the incumbent:
• Assist in the management and direction of criminal tax investigations;
- Conversion of allegations to investigations
- Formulation and modification of investigative plans
- Legal counsel on all aspects of criminal investigations
- Legal sufficiency of all CID-generated documents and legal pleadings
- Proper use of resources
- The closing of investigations
- Presentation of cases, in hypothetical form, to prosecutors
• Ensure the Section Heads (TA3) have all necessary information to adequately log requests for permission from the IRS to disclose Federal Tax Information (FTI) to a prosecutor when necessary;
• Review cases and, prior to criminal referral;
- Determine potential charges and the sufficiency of evidence to support those charges
- Evaluate sufficiency of Investigative and Audit Reports
• Prepare referrals for Deputy Commissioner;
• Act as a liaison between CID and New York State prosecutorial agencies, and assist in the prosecution of criminal tax evasion cases;
• Act as a hearing officer for the review of Certificate of Registration suspensions, and issue determinations;
• Conduct legal research and prepare legal memoranda on issues relating to the operations of the Criminal Investigations Division, DTF policy, the New York State Tax Law and the related Codes Rules and Regulations, the New York State Penal Law, and the New York State Criminal Procedure Law;
• Review legislation affecting CID and DTF and suggest legislative changes to the Tax Law to aid in CID’s and DTF’s operations and missions;
• Prepare/review search warrants, subpoenas, and other legal documents for the investigation of tax crimes;
• Prepare/review closing agreements for the repayment of tax liabilities and fulfillment of obligations to DTF;
• Participate in civil hearings and conferences as an advocate for DTF;
• Adhere to the department’s time and attendance rules.

Additional Comments We are seeking to fill two Associate Attorney (Tax Enforcement) positions. One position will work full-time out of the Brooklyn office and one position will work 50% in the Brooklyn office and 50% in the White Plains office.
