Job Specifics
Minimum Qualifications •Superior skills in legal analysis, legal writing and editing;
•More than five (5) years of litigation experience in both federal and state courts, including trials and the handling of complex litigation matters;
•Enjoy working within and assisting a large group of lawyers and support staff;
•Possess strong organizational and interpersonal skills; and
•Although previous supervisory experience is not required for the position, proven leadership skills and competence in defining and assigning priorities is a prerequisite for the position.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the OAG be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
Duties Description The New York State Office of the Attorney General (OAG) is seeking an experienced litigator to serve as a Deputy Section Chief in the Education Section of the Litigation Bureau in the New York City office. The Litigation Bureau represents the State of New York and its agencies and officers in state and federal courts in legal actions and proceedings relating to civil rights, education, social services, public employment, public health, law enforcement, corrections, state finance, insurance, taxation, and other litigated matters arising out of state operations and legislation.
The Education Litigation Section primarily represents the State University of New York, the senior colleges of The City University of New York, and the State Education Department. Additional clients include the Office of the State Comptroller and the Department of Transportation. The Section’s attorneys defend a wide variety of state and federal court actions involving, among other things, constitutional, civil rights, labor and employment, state regulation, and administrative law issues. The Section’s cases present a myriad of questions on constitutional law and statutory/regulatory interpretation, including matters of first impression, and generally have significant financial and policy implications for the State. Attorneys are responsible for all phases of litigation through trial and have frequent opportunities to present written and oral arguments in court.
Responsibilities of the Deputy Section Chief will include, but not be limited to:
•Assisting the Section Chief in the management and supervision of the Section’s extensive federal and state court litigation docket and will serve as lead attorney on, or otherwise closely oversee, the Section’s cases;
•Supervising approximately nine (9) attorneys and two (2) support staff members;
•Reviewing assignments of incoming litigation matters, including emergencies;
•Direction of or assistance in litigation of complex matters;
•Preparing and/or editing briefs and motion papers in a variety of matters;
•Appearances in court;
•Assisting in or conducting trials;
•Regular provision of advice, training, support and supervision to attorneys and support staff within the Section; and
•Evaluating proposed settlements; and
•Other duties, as assigned.
