Job Specifics

Minimum Qualifications The ideal candidate has at least five (5) years of federal and/or state court civil litigation experience, as well as some prior class action or complex litigation experience. However, a minimum of two (2) years civil litigation experience (including judicial clerkships, if any) is required. Superior writing, analytic, oral advocacy, and organizational skills are required.

In addition, the Public Officers Law requires that OAG attorneys be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description The Health and Human Services Section of the Litigation Bureau in the New York State Office of the Attorney General is seeking an experienced litigator to serve in the New York City office.

The Litigation Bureau defends the State of New York and its agencies and officers in federal and state courts in civil actions and proceedings relating to civil rights, education, social services, public employment, public health, law enforcement, corrections, state finance, insurance, taxation, and other matters arising out of state legislation, regulation, and operations.

Attorneys assigned to the Health and Human Services Section primarily represent and defend the State of New York’s health and welfare agencies—including the Department of Health, Office of Temporary and Disability Assistance, and Office of Children and Family Services—in federal and state court actions involving a wide range of constitutional, civil rights, public health, social services (including Medicaid, public assistance and food stamps), labor and employment, child welfare, juvenile justice, state regulation, and administrative law issues. Among other things, the Section handles a large number of class action and complex civil rights litigation matters involving the administration and supervision of important local, state and federal government public health, public assistance, and child welfare programs. The Section’s cases are often high profile, frequently present complex questions of constitutional law and statutory and regulatory interpretation, and have significant financial and policy implications for the State. The Section offers a diverse and stimulating litigation practice, with attorneys handling all phases of litigation from inception through trial and having frequent opportunities to appear in court.
