Job Specifics

Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to their admission to the Bar.

Preferred Qualifications: The preferred candidate will also have two years of experience as an Attorney in transactional work such as contracts or procurements.

Note: Appointment initially will be temporary until the position has been fully approved for
placement in the non-competitive jurisdictional class. At such time, a permanent appointment will be
made. This position is Phi designated which means the candidate will serve at the pleasure of the
appointing authority and appointment may be terminated at any time.

Duties Description The Associate Counsel, M-3 will be assigned to the Office of Legal Services (OLS) and will report directly to the Assistant Counsel. The primary responsibility of the Associate Counsel will be serving as the procurement and contract attorney for theAgency, in addition to performing the following duties:

• Draft, review and negotiate contracts for the agency, ensuring that documents include relevant clauses to comply with applicable legal requirements and protect the Agency’s best interests;
• Keep abreast of changes and updates to procurement processes and communicating new or revised policies and procedures to Agency staff;
• Advise Finance Office and program staff on procurement legal issues, including compliance with federal, state and local law;
• Keep General Counsel and Assistant Counsel apprised on all procurement and contract related issues;
• Train Senior Attorneys on the procurement and contract process;
• Draft legislation to assist in the implementation of new or revised criminal justice policies and initiatives;
• Work in conjunction with the Attorney General’s Office with regard to litigation involving DCJS;
• Work with the Affirmative Action Officer and Labor Relations on internal Agency employee investigations and certain disciplinary issues;
• Represent the Agency in arbitration regarding certain employee grievance issues;
• Research and analyze federal, state and local criminal justice legislation;
• Assist program areas with the development of policies and procedures to ensure they comply with all pertinent policies and applicable laws;
• Recommend policy and/or legislation based on changes in Agency rules, regulations, policy decisions, legislation or court decisions;
• Provide legal expertise and advice in the support of a multitude of high level public safety initiatives;
• Research various legal issues and questions in regard to criminal justice and public safety issues;
• Prepare written memos, letters, briefs and contracts as directed by the Assistant Counsel;
• Review legislation on criminal justice issues and draft legal memoranda addressing issues germane to the legislation;
• Draft legislation to implement criminal justice policies supported by DCJS and the Governor’s Office;
• Provide advice and guidance to Agency managers and staff regarding procurement issues, ensuring contracts are in accordance with all applicable laws, rules and guidelines; and
• May supervise subordinate staff as directed.
