Minimum Qualifications Admission to the New York State Bar and a member in good standing with two (2) years post-admission trial and/or hearing experience before either courts of record or in administrative proceedings. Commitment to public service and good research/writing skills essential. Criminal litigation experience preferred but not required.

Duties Description Attorneys assigned to the Administrative Appeals Unit perform the following functions, including but not limited to:
• Defend Justice Center determinations in proceedings before Administrative Law Judges.
• Prepare and cross-examine witnesses on behalf of the Justice Center in adversarial hearings.
• Draft motions, decisions and arguments in support of agency determinations.
• Review appeals challenging substantiated reports of abuse or neglect to determine whether a preponderance of the evidence supports Justice Center determinations.
• Review and conduct Justice Center investigations into substantiated allegations of abuse or neglect.
• Conduct statewide training with Justice Center investigators on Administrative Appeals practice.
• Travel is required up to 50% of time. *
*During the first 6 months of service, employee will be required to spend 50% of their time in Delmar, NY for training purposes.

Additional Comments The New York State Justice Center for the Protection of People with Special Needs (Justice Center) is charged with protecting over one million New Yorkers under the care or jurisdiction of six state agencies. The following list outlines several of the Justice Center’s key responsibilities:

• Advocate on behalf of individuals with disabilities and provide oversight of quality of care.
• Operate a centralized, statewide 24-hour hotline and incident reporting system staffed by trained personnel.
• Operate a statewide register that contains the names of individuals found responsible for egregious or repeated acts of abuse or neglect.
• Centralize and perform functions relating to criminal history background checks.
• Investigate serious allegations of abuse and neglect.
• Prosecute criminal acts of abuse and neglect.
• Analyze abuse patterns and trends in order to prevent future occurrences.

Position is eligible for $3,026 annual location pay factor.
