Duties Description POSITION DESCRIPTION:

The Office of the Counsel provides legal guidance and services to the Office for People With Developmental Disabilities (OPWDD) network on a myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. This position will provide administrative support for the Deputy Counsel of Service Delivery and Compliance and the Deputy Counsel of Policy and Regulations.

PRIMARY DUTIES AND RESPONSIBILITES:

• Review requests under the Freedom of Information Law (FOIL) and Personal Privacy Protection Law (PPPL), gather and review documents and draft determinations consistent with applicable statutory and regulatory requirements;
• Review of various kinds of documents to ensure agency compliance with applicable confidentiality requirements pursuant to the Mental Hygiene Law and Health Insurance Portability and Accountability Act of 1996 (HIPAA);
• Research and assist on matters related to agency compliance with statutory and regulatory requirements affecting programs related to the delivery of services for individuals with developmental disabilities;
• Research and assist on matters related to statutory and regulatory requirements affecting agency support operations such as, information security & HIPPA, and records management;
• Work with the attorney for administrative hearings, develop due process procedures and protocols for each OPWDD administrative review process;
• Develop and maintain systems for tracking of due process hearings;
• Track status of current hearing requests and ensure timelines are met by all involved staff;
• Develop and maintain systems for tracking HIPAA/Clinical records requests and Freedom of Information Law requests;
• Work with staff, assist in development of documentation and agency guidance documents;
• Work with FOIL staff, assist in gathering, reviewing and redaction of responsible documents;
• Assist in development of agency policies, including procurement, HIPAA, and other agency-wide policy documents;
• Perform other tasks as assigned by the Deputy counsels/General Counsel as needed.
