Duties Description PRIMARY DUTIES AND RESPONSIBILITES:

The Office of Counsel provides legal guidance and services to the Office for People with Developmental Disabilities (OPWDD) service network on the myriad of issues arising from the delivery of supports and services to individuals with developmental disabilities. This position will report to the Assistant Counsel for Service Delivery. The Bureau of Service Delivery and Program Compliance provides legal support on a wide variety of issues related to the Agency’s service delivery system including, but not limited to, the Medicaid waiver programs, Medicaid and non-Medicaid services, certification of providers and programs, individual rights and protections, and is actively engaged in the Agency transition to Care Coordination Organizations and Managed Care.

As a Senior Attorney, the incumbent will perform the following duties:

• Assist and advise with the development of Care Coordination Organizations and Managed Care;
• Represent OPWDD at administrative hearings pertaining to Aging Out placements;
• Represent OPWDD at Medicaid Fair Hearings pertaining to the reduction, suspension, or denial of Medicaid services;
• Advise on matters related to capacity and consent;
• Lead workgroups and navigate consensus building;
• Draft and review agency regulations, legislative initiatives and policies;
• Research and advise on matters related to the delivery of services for individuals with developmental disabilities;
• Assist and advise in matters related to Family Care, including development of suspension, revocation, or non-renewal of pertaining certificates issues to private individuals to provide care and treatment to persons who are developmentally disabled;
• Serve on Children’s Services Committee and provide advice related to family court matters;
• Draft Administrative Directive Memoranda (ADMS) and policies related to the delivery of services for individuals with developmental disabilities;
• Provide advice to Counsel’s Office attorneys and agency employees on State and Federal Medicaid issues and matters.
