Minimum Qualifications Candidates must be employed by New York State to be eligible to apply for this position.

Candidates who have one year of permanent service as a Senior Attorney OR who are eligible to transfer via Section 52.6 of the Civil Service Law by having at least one year of permanent service in a qualifying title are eligible to apply.

Candidates must be a member of the bar and licensed to practice in New York State.

Duties Description The Office of Mental Health (OMH) is recruiting to fill the position of Senior Attorney, G-25/Attorney 1, NS, in the Office of Counsel, Bureau of Policy, Regulations and Legislation. The Bureau of Policy, Regulations and Legislation oversees the preparation of the agency’s legislative agenda, regulations, and the OMH Official Policy Manual, and is responsible for filing all new OMH regulations in accordance with the requirements of the State Administrative Procedure Act. The Bureau also supervises agency compliance with agency confidentiality and health privacy rules. Specific duties to be performed may include, but are not limited to, the following:

Review various documents to ensure agency compliance with applicable confidentiality requirements pursuant to the Mental Hygiene Law and Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Research and advise on matters related to agency compliance with statutory and regulatory requirements affecting programs related to the delivery of services for individuals with mental illness.

Research and advise on matters related to statutory and regulatory requirements affecting agency support operations such as procurement, internal controls, information security & HIPAA, and records management.

Research and advise on issues related to administrative proceedings, review hearing records and draft proposed decisions.

Assist in drafting and reviewing interagency agreements.

Assist in drafting and reviewing proposed legislation, regulations and policy documents.

Assist in compilation and review of documents for large-scale Freedom of Information Law requests.

Perform other tasks as assigned by the General Counsel, House Counsel, and Deputy Counsel for Policy, Regulations and Legislation as needed.
