Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service in a legal title at G-28; OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a legal title at G-26 or above with current NYS Bar Admission and eligible for transfer under Section 52.6 of the Civil Service Law.
Preferred Qualifications:
The preferred candidate must possess strong legal skills and excellent oral communication skills. The preferred candidate must be able to prepare lengthy, complex, detailed and well- written decisions, with extensive findings of fact and conclusions. The preferred candidate must also have demonstrated good decision-making ability, must be able to maintain control in a contested hearing and must comply with legal deadlines for conduct of hearings and submission of decisions. Experience with complex, issue-driven administrative proceedings is desired.
Duties Description The incumbent will preside at complex and often lengthy DOH hearings pursuant to the Public Health Law, Social Services Law and various provisions of State and Federal Regulations. The position involves extensive travel throughout the State of New York and the incumbent would hold hearings at DOH Area and District Offices and at medical facilities. The incumbent must evaluate testimony and other evidence, and rule on motions. In physician disciplinary cases, the incumbent works with a three-member hearing panel from the State Board for Professional Medical Conduct (BPMC) and prepares a draft decision for approval by the BPMC hearing panel. In other cases, involving patient protection, emergency medical services, adult homes, or certificates of need, the incumbent prepares a recommended decision for the Commissioner of Health or various regulatory bodies within DOH. In still other cases, such as those involving early intervention services, nursing home resident discharges and recovery of overpayments from Medicaid providers, the incumbent prepares a final decision.
