Minimum Qualifications MINIMUM QUALIFICATIONS: Juris Doctor or a Bachelor of Laws (LLB) degree and/or eligible to take the New York State Bar examination.

PREFERRED QUALIFICATIONS: Experience assisting in the preparation of cases for adjudication or litigation related to employment and/or labor law, white collar crime, and/or conducting investigations and/or depositions is preferred.

Duties Description STANDARD DUTIES: Under the supervision of an Attorney and in collaboration with DOL investigators and the Deputy Commissioner for Worker Protection, you will assist with the preparation and representation of the Department’s unlawful retaliation investigations, enforcing Section 215 of the New York State Labor Law. Duties include but are not limited to:
- contact employer upon receipt of allegation to obtain real-time solutions to allegations of retaliation,
- conduct full investigation to determine whether retaliation occurred, including
o scheduling witnesses, issuing subpoenas, serving subpoenas, or arranging subpoenas for service,
o developing case files, manage large caseload
o conducting depositions and/or subpoena hearings
o drafting legal documents,
o serving as a liaison between defendant, their representatives and the investigation staff, drafting discovery demands, reviewing transcripts, analyzing and processing decisions and orders,
o preparing final documents for file closing, maintain tracking system for all cases
o preparing arguments for hearings in court or other venues,
o developing recommendations for modifying existing policies and procedures and for integrating new initiatives into existing program activities.
- Engage in settlement discussions between claimants and employers and represent the Department at compliance conferences (mediations).
- Review all retaliation investigation findings by the NYSDOL; provide advice and guidance to Labor Standards Investigators on retaliation investigations.
You may also develop investigation strategy, analyze and summarize cases, participate in planning litigation strategy, and coordinating with investigators.
