Job Specifics
Minimum Qualifications Eligible for a lateral transfer or a 70.1 transfer by having one year of permanent competitive service in an appropriate title. Appropriate titles include:
Child Protective Services Specialist 1, SG-16
Child Protective Services Specialist 1 Spanish Language, SG-16
Legal Affairs Specialist 1, SG-14
Legal Assistant 1, SG-14
Program Aide, SG-13
Program Aide Spanish Language, SG-13
OR
A provisional appointment may be made by having four years of paraprofessional or professional experience* providing services to individuals in need of and/or eligible for social services programs or implementing/administering programs regulated by the New York State Office of Temporary and Disability Assistance, and/or the New York State Office of Children and Family Services, and/or the New York State Department of Health.
*Qualifying paraprofessional or professional experience includes but is not limited to: experience as a social services or welfare examiner at a local or district agency, child protective caseworker, social worker for a social services or child protective program, a caseworker or counselor at a registered, not-for-profit or charitable agency.
Non-qualifying experience: Non-qualifying experience includes but is not limited to experience where duties are primarily routine clerical, office support staff or food service worker, which includes positions as a receptionist, secretary, file clerk, data/keyboard entry or cook.
Substitutions:
1. An associate or higher degree in law or legal assistant/paralegal education from a regionally accredited college or university, or college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS), may be substituted for the four years of experience required above.
2. Completion of a legal assistant/paralegal education, non-degree certificate program where the certificate was issued by a regionally accredited or ACICS accredited college or university AND two years of paralegal experience, may be substituted for the four years of experience required above. Completion of an external**legal assistant/paralegal certificate program is not qualifying.
3. College education in any field may substitute for up to two years of the above general experience at the rate of 30 semester credit hours or the equivalent, equaling one year of experience. College credit must have been received from a regionally accredited college or university.
Note: **Non-degree certificates of completion or diplomas awarded by a training institution or company not regionally accredited or accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) are not qualifying.
Duties Description Duties will include, but not be limited to, the following:
Processing a large volume of requests for fair hearings from clients and representatives seeking to appeal an adverse decision by a local social services agency or other agency relating to public assistance, medical assistance, Supplemental Nutrition Assistance Program, and services. Direct aid-to-continue, when appropriate. These requests are processed primarily by interviewing walk-in clients at this site but may include reviewing written requests received via correspondence, telephone, fax or electronically. Utilize the Fair Hearings Information System and other systems when processing transactions. Other tasks may include managing the calendar duties associated with the incoming appellants who appear for hearings. The incumbent will use a knowledge of the entire fair hearing process and administrative hearing procedures, including all applicable agency rules and regulations, to accomplish these tasks. The selected candidate must be capable of communicating with the Spanish-speaking population regarding fair hearing-related inquiries, requests and complaints. In processing written correspondence and e-mail requests, the incumbent must possess the ability to directly translate the incoming source documents without having to obtain verbatim written translations.
Additional Comments Full time permanent or provisional appointments will be made. If a provisional appointment is made, the candidate will be required to take the Legal Affairs Specialist 1 Spanish Language examination and must obtain a score that allows for their permanent appointment to the title. Incumbent must demonstrate and pass a Spanish language test to show their ability to understand Spanish and to speak it fluently. If certified by Civil Service, mandatory reemployment list candidates must be considered first for appointment to this title.
